Pornhub appeal denied?
Updated 21 October 2026
If Pornhub rejected your complaint, its own process is finished, but your options are not. If you live in the EU, you can take the decision to a certified out-of-court dispute settlement body, ask for a full statement of reasons, request your data under the GDPR, and keep the right to go to court. For creators with held payouts, the dispute body is usually the next step to look at.
Read the rejection against the law
Put the original decision and the rejection side by side. Check:
- Does Pornhub name the specific rule and the specific content or facts?
- Does it say whether automated tools were used?
- Does it explain how you can challenge the decision further?
- Does the answer read like a person looked at your case?
Under the Digital Services Act, Art. 17 requires all of the first three in the statement of reasons, and Art. 20 says complaints must not be decided by automated means alone. Write down every gap. It belongs in your next step.
Option 1: a certified dispute body
Under DSA Art. 21, a certified out-of-court body can review Pornhub's decision:
- It is free or a nominal fee for you.
- If you win, Pornhub pays the fees and your reasonable costs.
- The body decides within 90 days of receiving your complete complaint.
- The decision is not binding, but Pornhub must engage in good faith.
The Commission's list names no body for Pornhub yet. Pornhub's Terms say it cooperates with certified bodies, and general bodies may take the case. Use the dispute body finder and ask the body before you file.
Watch your dates. Pornhub's Terms say it may refuse a case that was already decided, or one brought after the six-month period without an internal complaint. Since you did complain, keep the rejection email as proof.
Option 2: ask for your data
Under GDPR Art. 15 you can ask for a free copy of your personal data. Pornhub's Privacy Notice names a data protection officer at [email protected] and gives one month to respond, with up to two more months for complex requests if they tell you why. Models who cannot use the request links can write to [email protected]. The copy can show what was recorded about your account, your uploads and your payouts. The deadline calculator tracks the dates.
Option 3: court
You can always go to court. Pornhub's Terms name the courts of Cyprus, so check where you can sue before you decide. With real income at stake, get proper legal advice first. We are not lawyers.
For models and studios
If you earn on Pornhub as a business, the P2B Regulation may also apply. It gives business users a statement of reasons when restricted or suspended, and at least 30 days' notice before termination, with exceptions. Whether it covers your account depends on the facts. Add your loss log to the dispute file: months affected, payouts expected from your own past statements, and payouts received.
Build one clean file
- The original notice, your complaint and the rejection, with dates.
- What was restricted or removed, and what was paid or held.
- Why the decision was wrong, in a few sentences.
- Proof: verification records, co-performer IDs and releases, payout statements.
- What you ask for.
What not to do
Don't open a new account to keep earning. That can count as getting around the ban and undermine your case. Don't pay anyone who claims a contact inside Pornhub. Outside the EU, these routes do not apply in the same way. If the rejection made the ban final, see permanently banned on Pornhub. The Pornhub overview has the rest, and the free ban checker shows which deadlines still apply to you.
What you stand to lose
A ban on Pornhub takes more than a profile. Think about what is on the account before you decide what to do.
- Years of photos, videos and posts you may not have saved anywhere else
- Messages and contacts, sometimes the only way you reach certain people
- The followers, subscribers or community you built
- Income: sales, sponsorships, payouts and the customers who find you there
- Other apps and sites where you sign in with this account
On Pornhub specifically
- Pornhub's terms say that once the terms end, you no longer have a right to access your account or your content.
- Model Program earnings. Pornhub's terms list restricting, suspending or withholding earnings and payouts among their enforcement measures.
Deadlines that are already running
- Pornhub's terms say the deadline for a complaint is six months after you are notified of the decision.
- Complaint to Pornhub: open for at least six months from the day Pornhub told you about the decision (DSA Art. 20).
- Copy of your data: free, and Pornhub must answer within one month of your request (GDPR Art. 15). It is worth asking now.
Questions people ask
Can I complain to Pornhub again after a rejection?
Sending the same complaint again rarely changes the outcome, and Pornhub's Terms say it can suspend access to the complaint system for people who often send manifestly unfounded complaints. A new complaint makes sense only with new facts or documents.
Which dispute body handles Pornhub cases?
The European Commission's list of certified bodies does not name one for Pornhub. Pornhub says it cooperates with certified bodies, and general bodies may take the case. The dispute body finder helps you compare them.
Is a dispute body's decision binding on Pornhub?
No. Pornhub's Terms say so too. But under the DSA Pornhub must engage with the body in good faith, and a reasoned outside decision is a strong document if you later go further.
Can Pornhub refuse a dispute body?
Its Terms say it may refuse if the same dispute was already decided or is pending, or if you went to the body after the six-month period without filing an internal complaint. So check your dates before you start.
